Electronic evidence preservation for legal practice

Before you file, preserve the evidence.

Electronic evidence may arise from Android and iOS devices, messaging applications, email, computers, cloud accounts, websites, CCTV systems, servers and storage media. SakshyaSetu assists counsel in preserving the available record, its provenance and its handling history for considered legal review.

The contemporary evidentiary landscape

An electronic record extends beyond what appears on screen.

The material placed before counsel may originate in a device, account, application database, cloud backup, server or camera system. Its legal assessment can require more than the visible content: the source, surrounding context, manner of production and subsequent handling may all become relevant.

01 / RECORD PRESENTED

Electronic material produced for legal advice

Messages, recordings, documents and system outputs may reach counsel in several forms and at different stages of a matter.

02 / SOURCE AT RISK

The device, account, post or original recording

Devices are replaced, chats are cleared, posts change, camera systems overwrite footage and logs rotate.

03 / LEGAL REVIEW

Provenance, completeness, production and handling

Who controlled the source? Is the conversation complete? How was the record produced and what happened to it next?

04 / PRESERVATION VALUE

Retaining the explanatory trail while it exists

Timely preservation helps retain material that may later assist counsel, an expert and the court in understanding the electronic record.

Timely preservation

The value of preservation is determined before the source changes.

An electronic record may remain capable of proof through different legal routes. Early preservation helps counsel retain available material relevant to its source, integrity, manner of production and handling. It does not predetermine admissibility or evidentiary weight.

WHERE PRESERVATION BEGINS LATER

Reconstruction after the event

  1. The material is identified after copies have circulatedIts contents may be available, but initial source details were not recorded.
  2. Conversion or forwarding has occurredThe relationship between the copy and its originating source requires reconstruction.
  3. The device, account or system has changedThe best available source or surrounding context may no longer exist.
  4. Production details are assembled retrospectivelyCounsel must work with the material and witnesses that remain available.

The record may remain capable of proof, but the available source context can be more difficult to establish.

WHERE PRESERVATION BEGINS EARLY

A documented preservation record

  1. Counsel refers the matter while the source existsThe record and urgency are assessed.
  2. Source and lawful custodian are identifiedThe device, account or system context is recorded.
  3. The best available record is preservedIntegrity and subsequent handling are documented.
  4. Section 63 inputs are organised for reviewCounsel retains control of pleading and filing strategy.

Counsel receives an organised preservation record for independent review and considered filing.

SakshyaSetu preserves and documents the available electronic record. It does not decide authenticity, admissibility or evidentiary weight; those remain matters for counsel, the appropriate expert and the court.

Matters we can help assess

Digital records appear in almost every kind of dispute.

Our first conversation identifies what exists, how quickly it may change and whether guided preservation, lawyer review or specialist forensic support is the sensible next step.

RECORD TYPES

The source changes. The need to preserve context does not.

We assess the record and guide the appropriate first response without asking you to disclose more than the matter requires.

WhatsApp & chats social posts web pages CCTV photos & video audio email cloud files business records DVR/NVR exports computer files server & system logs USB & storage media

A careful first response

Simple for the client. Useful for counsel.

The public website begins the conversation. Source-specific guidance and documentation follow only after the matter and record type are understood.

Discuss a record
01

Tell us what exists

Share the record type, where it is held and why you believe it may be changed, deleted or disputed.

02

Do not alter the source

We give practical first guidance before unnecessary forwarding, editing, conversion or repeated handling creates avoidable questions.

03

Preserve through a guided process

The relevant source and surrounding context are captured through a matter-appropriate preservation session.

04

Prepare for legal review

The preserved material and handling record are organised so counsel and, where needed, an independent expert can review the next step.

For advocates and law firms

Your chamber's digital evidence desk.

Clients should not have to find a forensic laboratory before speaking to counsel, and counsel should not have to master every phone, operating system, camera format or cloud platform. SakshyaSetu provides the specialist preservation path while the advocate retains command of the matter.

Sakshya Setu is operated by Gnovations Technologies Pvt. Ltd. It is an independent preservation support initiative; legal advice and representation remain with the instructed advocate.

Start while the record still exists

Tell the evidence desk what you need to preserve.

A few clear lines are enough. Do not upload confidential evidence through this enquiry form. We will first explain the appropriate and secure next step.
